BURMA: UN EXPERT CALLS ON GOVERNMENT TO ADDRESS IMPUNITY FOR CRIMES IN
RAKHINE New York, May 1 2013 1:00PM While welcoming the most recent
efforts of Burma's Government to look into the sectarian violence that
erupted last year in Rakhine state, a United Nations expert today
stressed that much more needs to be done to end discrimination and
hold perpetrators accountable for their crimes.
The Special Rapporteur on the human rights situation in Burma, Tomás
Ojea Quintana, said that while the recommendations of the Rakhine
Investigation Commission report address the humanitarian situation in
the region, they still restrict the movements of the Muslim community
in particular.
"The Investigation Commission's report contains many worthwhile
recommendations, which I encourage the Government of Burma to
implement," said Mr. Ojea Quintana after reviewing the recommendations
of the 27-member Commission, set up last year by President Thein Sein
in the aftermath of the violence between Buddhists and Muslims that
spiked in June 2012 and then again in October.
Those recommendations included measures on addressing the dire
humanitarian situation in the Muslim camps for internally displaced
people (IDP), such as overcrowding, access to clean water and
sanitation, the risk of disease, food security and child malnutrition,
as well as on improving access to education and livelihoods.
"However, in implementing them, I urge the authorities, as a matter of
urgency, to ease the harsh and disproportionate restrictions on the
freedom of movement of Muslim populations in the IDP camps and also in
Muslim residential areas, such as Aung Mingala in Sittwe and across
northern Rakhine State, while also providing adequate security," he
said.
Those restrictions greatly exacerbated the humanitarian situation,
restricting access to food, healthcare, livelihoods and education, he
said, adding: "Now we are at the beginning of May and the harsh
restrictions for Muslim populations remain firmly in place." In a
report to the Human Rights Council, Mr. Ojea Quintana had previously
noted that the Taung Paw camp in Myebon felt more like a prison than
an IDP camp.
The Special Rapporteur praised the report's recommendations to double
the presence of police, military and border security forces in
Rakhine, but said accountability for human rights violations must also
feature prominently in the Government's agenda.
"I have received credible allegations that widespread and systematic
human rights violations by state officials targeted against the
Rohingya and wider Muslim populations have occurred and are continuing
in Rakhine state. These involve the most serious of allegations,
including extrajudicial killings, rape and sexual violence, arbitrary
detention and torture and ill-treatment in detention, deaths in
detention, and denial of due process and fair trial rights," He said.
"The Government has an obligation under international law to
investigate these allegations effectively, promptly, thoroughly and
impartially and, where appropriate, to take action against those
responsible, in accordance with domestic and international law," he
said, adding that accountability is an integral part of restoring
relations of trust and harmony among ethnic and religious communities.
Mr. Ojea Quintana also expressed concern over the recommendation that
communities should continue to be separated while emotions remain
high, noting that the Government must plan for integrated communities
as homes are rebuilt and people resettle to avoid permanent
segregation.
"I have always said that discrimination against the Rohingya Muslims
in Rakhine state is one of the underlying causes of the violent
conflict between communities there," he said. "The statelessness of
the 800,000 Rohingya population underlies their marginalization and
makes them particularly vulnerable to discrimination and human rights

Nations independent human rights experts today reiterated their calls
on the United States to shut down the detention centre.
"The United States must respect and guarantee the life, health and
personal integrity of detainees at the Guantánamo Naval Base,
particularly in the context of the current hunger strike," a group of
international experts on human rights, arbitrary detention, torture,
counter-terrorism and health said in a

release from the Office of the High Commissioner on Human Rights
(OHCHR).
The experts, who comprise the Inter-American Commission on Human
Rights, added that they have received specific information about
severe and prolonged physiological and psychological damage caused by
the high degree of uncertainty the detainees face over basic aspects
of their lives, such as not knowing whether they will be tried or
whether they will be released and when; or whether they will see their
family members again.
The Commission also today urged the US Government to adopt concrete
measures to end the indefinite detention of persons; to ensure the
detainees are either released or prosecuted in accordance with due
process and the principles and standards of international human rights
law; and to allow for independent monitoring by international human
rights bodies.
President Barack Obama said yesterday that he would recommit himself
to closing the Cuba-based prison, a goal he has voiced at least three
times in the past four years but which is hampered by Congressional
opposition.
"You can't just set up something like that and keep it in perpetuity,
which is in fact what Congress has made possible by bringing in a new
law in the beginning of the year called the National Defence
Authorization Act which essentially provides for the indefinite
military detention without charge or trial of detainees at Guantánamo
Bay," Rupert Colville, a spokesperson for the UN Human Rights Office
told UN Radio.
In today's statement, the Special Rapporteur on torture, Juan E.
Méndez, noted that the indefinite detention of individuals, most of
whom have not been charged, "goes far beyond a minimally reasonable
period of time and causes a state of suffering, stress, fear and
anxiety, which in itself constitutes a form of cruel, inhuman, and
degrading treatment."
Around half of the 166 detainees in the centre have been cleared for
transfer to their home countries or third countries for resettlement.
"All relevant security-related Government agencies or authorities have
expressly certified that those detainees do not represent a threat to
US security," said the Special Rapporteur on countering terrorism, Ben
Emmerson.
However, the cleared detainees continue to remain in the centre,
alongside those reportedly designated for indefinite detention.
"Of those, 56 are Yemeni nationals who have been denied release based
solely on their nationality and on the political situation in Yemen,
which constitutes a clear violation of the principle of
non-discrimination and renders their detention arbitrary and
constitutes a flagrant violation of international law," explained El
Hadji Malick Sow, who currently heads the UN Working Group on
Arbitrary Detention.
Last month, the High Commissioner for Human Rights, Navi Pillay, said
she was "deeply disappointed" by the US inaction on closing the
centre. She also noted that the continued incarceration of cleared
detainees raised serious concerns under international law and severely
undermined US stance as an upholder of human rights.
Speaking with UN Radio today, Mr. Colville said the ongoing hunger
strike is a manifestation of the uncertainty felt by the detainees.
"One can only imagine the feelings of these people who one minute
they're told they're cleared for transfer home and then it doesn't
happen. You've got now this hunger strike which is really a symptom of
extreme desperation," he said.
According to media reports, 21 of the reported 100 striking detainees
are being force-fed a nutritional supplement through tubes inserted in
their noses.
While the individual circumstances of those detainees are unclear, the
UN Special Rapporteur on health, Anand Grover, stressed that "health
care personnel may not apply undue pressure of any sort on individuals
who have opted for the extreme recourse of a hunger strike."
She added that it is also not acceptable to use threats of forced
feeding or other types of physical or psychological coercion against
individuals who have voluntarily decided to go on a hunger strike.
Independent experts, such as the special rapporteurs cited, are
appointed by the Geneva-based UN Human Rights Council to examine and
report back, in an unpaid capacity, on specific human rights

experts gathered at a United Nations forum in Bangkok told
participants today.
"First and foremost, Governments must invest in prevention and
preparedness – it is far more effective and less costly than recovery
efforts," said the Executive Secretary of Economic and Social
Commission for Asia and the Pacific (ESCAP), Noeleen Heyzer, at the
Commission's Ministerial Roundtable on Building Resilience to Natural
Disasters and Major Economic Crises.
"This can be as straightforward as updating building codes and
retrofitting unsafe buildings, or as far-reaching as coordinating
regional monetary policies."
Regarding economic crises, Ms. Heyzer stressed that policymakers must
balance short-term stability with long-term development. "In the midst
of a crisis or disaster, we can ill-afford to mechanically apply the
conventional norms of macroeconomic stabilization. We need an
Asia-Pacific regional framework for resilience."
The roundtable was guided by a new ESCAP study which found that
multiple shocks are occurring with increased frequency and are
converging in new ways.
During the discussion, crisis management experts from the Association
of Southeast Asian Nations (ASEAN), Indonesia, Pakistan and the
Philippines agreed that countries' resilience to natural disasters and
economic crises is based on preparation, and noted the important role
of regional cooperation in building this resilience.
The Asia-Pacific region has had extensive experience dealing with
natural disasters. Pakistan suffered a devastating earthquake in 2005,
as well as floods in 2010, local governments in the Philippines
prepare and plan for cyclones every year, and countries in the region
have developed warning systems to prepare for tsunamis, following the
2004 Indian Ocean tsunami which killed hundreds of thousands of
people.
At the forum, Deputy Secretary-General Jan Eliasson issued an urgent
call to protect the poor and vulnerable during natural disasters and
economic crises. "The poorest are the most vulnerable during
disasters, and we see that all over the world. We must build back
better so we are better prepared for the next time.
"We definitely need to make disaster risk reduction part of the
development paradigm and the post 2015 development agenda and reach
out to the private sector, civil society, academia and the scientific

before entering Great Basin National Park .
As of February 22, 2010, a new federal law allows people who can
legally possess firearms under applicable federal, state, and local
laws, to legally possess firearms in Great Basin National Park.
It is the responsibility of visitors tounderstand and comply with all
applicable state, local, and federal firearms laws before entering
this park. As a starting point, please visit the following State of
Nevada websites concerning the ability to carry concealed weapons:

Federal law also prohibits firearms in certain facilities in this park
(seebelow) ; those places are marked with signs at all public
entrances. This includes, but is not limited to; visitor centers, and
government offices.
Nevada currently recognizes a CCW(concealed carry of a weapon) permit
from 10 states. The states are Alaska, Arizona, Arkansas, Kansas,
Kentucky, Louisiana, Michigan, Missouri, Nebraska, Ohio, Tennessee,
and West Virginia. NOTE: NEVADA NO LONGER recognizes UTAH permits.
This list is subject to change. Contact the Nevada Attorney General's
office for the most current information and regulations.
What Changed?
Section 512 of the Credit Card Accountability Responsibility and
Disclosure Act of 2009 , P.L. 111-24, 123 Stat. 1764-65, allows
persons to possess firearms while in units of the National Park and
National Wildlife Refuge Systems if they are in compliance with
applicable federal and state law. Specifically, Section 512(b) states:
The Secretary of the Interior shall not promulgate or enforce any
regulation that prohibits an individual from possessing a
firearmincluding an assembled or functional firearm in any unit of
theNational Park System or the National Wildlife Refuge System if--
(1) the individual is not otherwise prohibited by law from possessing
the firearm; and
(2) the possession of the firearm isin compliance with the law of the
State in which the unit of the National Park System or the National
Wildlife Refuge System is located.
Section 512 becomes effective on February 22, 2010. Section 512
affects implementation of the existing NPS regulations regarding the
possession of firearms in national parks, by now allowing individuals
to possess firearms if
(1) they are not otherwise prohibited by law from possessing the firearm and
(2) such possession is in compliance with the law of the state in
which the park unit or that portion of the unit is located.
Section 512 applies to possession of firearms within the National
ParkSystem regardless of the jurisdictional status of the
unit—exclusive, concurrent or proprietary.
Within the park, the following buildings are designated as
"federalfacilities" and firearms are prohibited within:
Lehman Cave
Great Basin Visitor's Center
Lehman Caves Visitor's Center
Café and Gift Shop
Lower Resource Management Offices
Great Basin Wildland Fire Engine Bay
Great Basin Wildland Fire Cache Buildings
Great Basin Maintenance Complex Buildings
Protection Offices
Structural Fire Engine Bay
SAR Cache/Fitness Center
Upper Resource Management Offices
